Terms of Service

Last updated: 23 September 2026

These Terms of Service ("Terms") govern your use of Anytime Mail, operated by Xactavent (Pty) Ltd, of which Anytime Mail is a division ("Anytime Mail", "we", "us"). By creating an account, you agree to these Terms.

1. What Anytime Mail is

Anytime Mail is a tool that lets you send bulk email campaigns through your own SMTP mail server (or, for bureau clients, through a mailbox operated by us on your behalf). We provide the sending infrastructure, pacing, list verification, tracking, and reporting. We do not supply contact lists, and we are not the "data controller" of any list you upload.

2. Your contact list is your responsibility

You are solely responsible for the lawfulness of every contact list you upload or send to, including that:

  • Every recipient has given valid consent to receive email from you, in line with the Protection of Personal Information Act (POPIA) and any other applicable data protection or anti-spam law in the jurisdiction(s) you are sending to or from;
  • The list was not purchased, scraped, or otherwise obtained without the knowledge or consent of the people on it;
  • You will honour unsubscribe requests and keep your list up to date.

Anytime Mail does not vet, audit, or take responsibility for the source, accuracy, or consent status of any list you bring to the platform. If a list you upload results in spam complaints, blacklisting of a sending domain, regulatory complaints, or legal claims, that responsibility sits with you, not with Anytime Mail. We reserve the right to suspend or terminate any account we reasonably believe is sending to a non-consenting, purchased, or scraped list, without refund of any credit already spent.

3. Sending limits

To protect sending reputation across the platform, every connected mail account is subject to an hourly sending cap, and some are additionally subject to a daily cap, both set to reflect the real limits of the sending infrastructure involved. These caps may differ between accounts and may be adjusted by us where needed to protect deliverability. Campaigns are queued and paced automatically; we do not guarantee a specific delivery time beyond "as soon as your position in the queue and your account's caps allow."

4. Your own mail server / SMTP

You connect your own SMTP mail server (or, for bureau clients, we connect ours on your behalf). We strongly recommend using a dedicated mailbox for campaign sending rather than your everyday inbox, since bulk sends generate a high volume of automatic replies, bounces, and out-of-office messages. We are not responsible for the deliverability, reputation, or technical performance of any mail server you connect, nor for any consequences of your mailbox receiving a high volume of automated replies as a result of your sending.

5. Subscription option

As an alternative to pay-as-you-go pricing (see clause 6), we offer a monthly subscription. Subscription pricing, the minimum term, and payment terms are set out in your separate Subscription Services Agreement. While your subscription is active and in good standing, campaigns sent through your account are not metered or charged per recipient — sending is instead governed by the caps described in clause 3. A subscription does not override or replace clause 2 (your responsibility for your contact lists) or clause 7 (account suspension).

6. Pay-as-you-go pricing

If you are not on an active subscription, Anytime Mail is pay-as-you-go: credit is purchased in advance and deducted at R500 per 5,000 recipients (rounded up to the nearest 5,000) at the moment a campaign is launched or scheduled. Credit, once spent on a launched campaign, is non-refundable, including where a campaign fails partway through due to an issue with your own SMTP server or contact list. Unused credit does not expire. We also offer a Bureau service — where we send on your behalf using our own sending infrastructure — priced separately; current Bureau pricing is available on request.

7. Promo codes

From time to time we may issue promo codes that add free credit or grant a fully complimentary ("unlimited") account, at our sole discretion. Promo codes are non-transferable, may be restricted to a specific account or number of uses, and may be withdrawn or deactivated at any time without notice.

8. Account suspension

We may suspend or terminate any account, without refund, where we reasonably believe it is being used for spam, sending to non-consenting recipients, fraud, or any activity that puts our sending infrastructure, other users, or our reputation with mail providers at risk.

9. No warranty, limitation of liability

Anytime Mail is provided "as is." To the fullest extent permitted by law, we disclaim all warranties regarding uptime, deliverability, or fitness for a particular purpose. For pay-as-you-go and Bureau clients, our total liability to you for any claim arising from your use of the service is limited to the credit you have purchased in the three months preceding the claim. For subscribed clients, our total liability is limited to the subscription fees you have paid in the three months preceding the claim.

10. Indemnity

You agree to indemnify and hold Anytime Mail harmless against any claim, fine, or loss arising from your contact list, your campaign content, or your failure to comply with applicable law.

11. Governing law

These Terms are governed by the laws of South Africa.
